According to "European Report Magazine", the European Union's legal service are questioning the legality of the tobacco ban. The Legal Advisor of the European Council indicated that directives to member countries under article 129 of the Treaty of Rome are not allowed.

"This is the international business of the council," said a spokesman for the Council of Europe, "But there is nothing new in the fact that our lawyers questioned the legality of the directive. It will now come before the European Court."
